"This Guy Has No Standing" posted by ~Ray

In. Nebraska Democratic State Senator Ernie Chambers “filed a lawsuit against God in Douglas County Court.”“The Constitution requires that the courthouse doors be open so you cannot prohibit the filing of suits,” Chambers says. “Anyone can sue anyone they choose even God.”I don’t think it quite works that way. In order to have to bring a suit you not only have to be affected there has to be “a likelihood that the injury will be redressed by a favorable decision which means that the prospect of obtaining relief from the injury as a result of a favorable ruling is not too speculative.”Somehow I don’t think God is taking orders from the Douglas County Court. As he said in another (perhaps not so altogether different) . “Who is this that darkens my counsel with words without knowledge?” “Will the one who contends with the Almighty correct him? Let him who accuses God answer him!”My immediate reaction to hearing the case and that it had to do with tort reform was that the guy must be providing an example of a completely idiotic and frivolous lawsuit in order to spur action on tort reform. I never thought he’d be opposing it! There’s likely to be a backlash to outlaw this sort of stunt and all kinds of other frivolous litigation. has a link to in which the case was dismissed for similar reasons: “the Court has serious doubts that the complaint reveals a cause of action upon which relief can be granted by the court. We question whether plaintiff may obtain personal jurisdiction over the defendant in this judicial district.” This entry was posted by on Tuesday. September 18. 2007 at 07:22 and is filed under. You can or from your own blog. All new comments are subject to moderation before being displayed. I always liked Senator Chambers as an “agent of wakefulness.” With him around other Senators could not pursue absolutely conformist policies without considering what wild charge Chambers might show up with. I knew some of the things he was doing were if not grandstanding perhaps not as sincerely intended for serious acceptance as some people took them to be. But he did get people to pay attention and think of alternatives. Kids like me liked to see the cages rattled where the most conformist and out-of-touch people resided. Where else would that be but in political office buildings!I wonder if “The Unicameral” would have half the difficulties with both Chambersesque and non-Chambersesque opposition -- and do less back-tracking! -- if 90% of its members had even a 10% understanding of the rationale behind and the need for a balancing checking second camera. A second or even third chamber would bog down some members’ wilder efforts and show by its approval which cries were to be taken more seriously. I’ve studied the arguments for a unicameral. All the difficulties of which the Federalist Papers warned us have found life in that body. Ernie Chambers is one of those quixotic not idiotic vivivorous not frivolous life-enriching characters who will if we wait long enough be seen to have taken both sides of an issue. How staid but (more) boring the Unicameral would be without him. To prevent automated Bots from commentspamming please enter the string you see in the image below in the appropriate input box. "The 10 Best Foods You Aren't Eating" posted by ~Ray
Posted on 2007-11-27 20:13:23

recently posted a conjoin on foods that are incredibly good for you but not many guys eat them. Considering one is a weed called purslane. I'm not surprised. What makes the article a must-read is not just telling us what we should be eating and what the health benefits are but including a divide on how to alter and eat them. Which in most cases is easier than you think. (Purslane? Just add it to a salad. Even though it's a weed it has a mild lemony taste.)The top ten are: Beets. steal. Guava. Swiss chard. Cinnamon. Purslane. Pomegranate juice. Goji berries. Dried plums and Pumpkin seeds. And to see why they made the list and the beat way to eat them. . This pass I'm headed to Vegas with three buddies for some gambling anddrunken debauchery. A bring together of us go for the gambling. A couple for thenon-stop partying. Why do you go? The Bachelor Guy is strictly editorial. He cannot be bought. Seduced maybe. But not bought.

"iPhone Hack" posted by ~Ray
Posted on 2007-11-17 16:07:58

Every geek Guido knows is twitchy about getting an iPhone from Apple. The snag is that in addition to the high handset cost (£269) the monthly rental includes an overcharged lock-in to Apple's furnish 02 mobile communicate. Now hackers undergo figured out how to unlock the phone and connect it to any network without the high-priced monthly charges. Apple have put their U. S lawyers on the inspect trying to compel some kind of corporate communism. You buy the phone but it is not your property to do with as you please if Apple get their way. (The big pharmaceutical companies try to do the same with their products stopping you importing them from cheaper markets.)Big business uses lobbyists to get politicians to pass laws that favour their clients rather than the common good. It is special pleading and protectionism of the worst kind. In the coming months Guido will be on the be out for examples of lobbyists using MPs to advance private corporate interests at the depreciate of consumers. It is a murky world that people in Westminster are reluctant to communicate about. Full of ex-MPs ex-SpAds and on-the-make spivs. They like to do business behind closed doors but you'll catch rare sight of them in the open at the party conferences. Lavishing food and consume on anyone they think useful to their client's interests... Email with any examples of lobbyists trying to screw the public for their clients. Like you am also twitchy about the iPhone.. but not with such a shite broach on the table. One suggestion doing the rounds - get a US addressee to buy and affix it on to you (needs to be "a enable") and do the open thing yourself - then stick your sim card in. Here's an idea "Guido" you don't like the terms Apple sells its property to you don't buy it. Remarkable things choice and the freedom to form contracts - wouldn't you say? anon 4:42,Touched a raw nerve there has he you wouldn't have your snout in one of the particular troughs Guido refered to would you by any come about ? Feck me Guido your going to be busy. The list is almost endless i e the financial companies be weak governance so they sell dodgy products arms companies wanting favourable export laws big employers wanting weak employment laws etc etc. On a connected subject any advance with the Lord Cashpoint carry on? As far as I'm aware that "hack" includes taking the back of the iphone off soldering different sections together and having a pretty high aim knowledge of geekery and programming. So fairly unlikely for your add up punter to take advantage of. There is a hack to bypass the AT&T registration in America but then that leaves the iPhone phone-less for which you might as well buy an iPod touch instead. If you feel up to the hack the hacker describes it. If there's a software only hack then I stand corrected but I was unaware there was one. Haha! There is a good reason Apple has tied the iPhone to one carrier and locked out 3rd party developers namely so it doesn't quickly turn into something resembling a piece-of-shit Windows mobile device. Given this is a new industry Apple is venturing into it seems wise to control the product so that it actually works and is fun to use; to merge and then change state it up. Shouldn't Jobs really be making sure his product works before releasing it to any consumers rather than using paying O2 customers as guinea pigs? Not that I care. I'm on Orange It's the same with games consoles which undergo regional lock-ins. Hackers produce software or chips to unlock consoles so they can play games from other regions such as the US or Japan and steal games. guard undergo raided these hackers and the console manufacturers are creating firmware updates which make unlocked consoles stop working. So much for consumer freedom. Julian wake up! Apple is being discussed! Your 2 cents-worth please! The best hack for an iPhone or any mobile phone is with a play unify and well into the long grass. 21st-century leg-irons that's what they are. I normally accept with you but what a load of cobblers this post is- if you don't want to pay the price buy something else. I'd desire a ferrari but the price isn't justified by performance same with apple- the drug companies are sometimes forced to sell low in some countries or decide to in others. The first lot don't have any dug companies as they don't alter any money there. The back up lot are dirt poor. I presume you are advocating drug companies sell Aids drugs to South Africa at the same price as the USA or England. How many people do you want to die My God an Apple discussion without the Microsoft astro-turfers taking the opportunity to express us that 'Macs suck. Windoze rules. Steve Jobs can't even end what clothes to wear and plate is not the new beige'. Been told that I should be getting an O2 iPhone on 24th September - cost £19.00 on the VIP function. The criminal offence of the unauthorised unlocking of phones is not enforced. It is an offence under the Communications Act and only OFCOM are empowered to enforce it - OFCOM don't employ foot-soliders. I imagine O2 will be oh-so-pleased if they undergo to forbid using the 'tough the 14 days are up it's your's now' forgive for refusing to refund or replace the faulty egest they (or their agents) change you. What you are suggesting will be consumer heaven Guido. When your iphone packs in you can call O2 and say 'YOU'RE iphone isn't working'. Sorry to go on about this subject but the point just has to be made. Where there is money and great deals to be done in corporate business especially you can bet your testicles again Guido on this. remove masons or some other far worse but related secret elite have got their manicured touch prints all over the place. Guido. I like your point. Companies using MP's to act upon the merchandise is a bad thing and needs to be outed! The only problem though using Apple as an example is that their business model is more complex than the simple supply a product model. The subscription is move of the product so you should accept that cost as being move of the overall price. Apple are well within their rights to specify their business conditions - your choice is to buy it or not. If on the other transfer you are wanting to buy a second transfer product then I would agree with you that the ability to alter the contractual obligations should be available. The seller would not be Apple and so all original deals should be off!Being a libertarian is more complicated than it seems! peason tell me that the iFone is a compleet fail esp as it will only be available on O-dere the apple-munching jobbies currently clenching hard to direct it all in would do come up to bequeath the cyber-guerillas' cry of yore e g.
